Notice to an Owner in Foreclosure

If your property goes to the foreclosure auction sale and is purchased for more than the total owed to the lender and to all other lien holders, please contact the Public Trustee’s Office (at the phone number or address to the right) after the sale because you may have funds due to you.

If a borrower believes that a lender or servicer has violated the requirements for a single point of contact in Section 38-38-103.1, C.R.S., or the prohibition on dual tracking in Section 38-38-103.2, C.R.S., the borrower may file a complaint by visiting the Colorado Attorney General website, the Federal Consumer Financial Protection Bureau (CFPB), or both. The filing of a complaint will not stop the foreclosure process.

Public Trustee Information

The Public Trustee is responsible for processing Releases of Deeds of Trust and Foreclosures on Deeds of Trust.

What are the requirements for filing a release of deed of trust? C.R.S 38-39-102


To release a Deed of Trust with production of evidence you will need to complete the following:

  • Submit the completed and signed release form to the Public Trustee's office
  • Provide a copy of the Deed of Trust
  • Provide the original promissory note marked paid in full or canceled
  • Provide a self-addressed stamped envelope to mail back the completed release 
  • Check made payable to Delta County Public Trustee in the amount of $73.00

To release a Deed of Trust without production of evidence you will need to complete the following:

  • Submit the completed and signed release form to the Public Trustee's office
  • Provide a copy of the Deed of Trust
  • Provide a self-addressed stamped envelope to mail back the completed release 
  • Check made payable to Delta County Public Trustee in the amount of $73.00

Releases are processed on Fridays, with the exception of holidays; they will be processed the prior business day. Release forms can be found at https://cctpta.org/public-trustee-forms/
